PFAS Lawsuit Eligibility: Who Can File a Forever Chemical Claim
PFAS claims involve exposure to per- and polyfluoroalkyl substances, the "forever chemicals" found in contaminated drinking water, firefighting foam (AFFF), some workplaces and certain consumer products. People bringing these claims say manufacturers failed to warn about serious health risks.
The U.S. Environmental Protection Agency lists contaminated drinking water and firefighting work among PFAS exposure routes and reports a higher risk of certain cancers, including kidney and testicular cancer. The International Agency for Research on Cancer classifies PFOA as carcinogenic to humans and PFOS as possibly carcinogenic.

A March 17, 2026 case management order (CMO 26N) covered a Group B bellwether pool of thyroid disease and ulcerative colitis plaintiffs, noted that most party discovery was complete and set a July 20, 2026 deadline for selection and expert discovery proposals.
PFAS Lawsuit Eligibility Requirements
Eligibility depends on an individual legal and medical review. In general, you need evidence tying meaningful PFAS exposure to a diagnosed condition, a responsible defendant and a timely filing.

Exposure may come from AFFF foam, contaminated public or private water, chemical plants, airports, military bases or certain industrial jobs.

Where PFAS Exposure Comes From
AFFF Firefighting Foam
Fire departments, military bases, airports, refineries and industrial plants have used AFFF to fight fuel fires. Work records, training logs, incident reports and duty assignments can document exposure.
Contaminated Drinking Water
Utility test results, state environmental records, EPA data, private well tests and your address history can show whether you lived in an affected area.
Industrial and Product Exposure
Chemical manufacturing, metal plating, textile treatment and paper production can involve PFAS. These claims require careful identification of the source and defendant.
A 2023 U.S. Geological Survey study estimated that at least one PFAS could be detected in about 45% of U.S. tap water samples. That national estimate does not prove exposure at a particular address, so location records are still needed.
