PFAS Settlement Calculator 2026: What Could a PFAS Lawsuit Payout Look Like?

Curious about a possible PFAS lawsuit payout? This free PFAS settlement calculator helps you sort the facts that matter in an injury claim involving AFFF firefighting foam or PFAS-tainted water: how you were exposed, your diagnosis and treatment, financial losses, the strength of your evidence, potential defendants and timing issues.

Quick answer: Courts have not approved any nationwide payout schedule for individual PFAS injury claims. According to the August 3, 2026 JPML report, AFFF MDL 2873 had 15,246 actions pending and 19,822 historical actions. The multibillion-dollar public water system settlements are separate from individual cancer and injury claims.
15,246MDL 2873 actions pending, per the JPML's August 3, 2026 report
Aug. 242026 deadline for Rule 702 motions on thyroid and liver cancer general-causation experts
Nov. 202026 deadline for Group B selection and expert-discovery proposals
  • Keeps individual injury claims distinct from water system settlements.
  • Reflects the August JPML count and the court's July 30 orders.
  • Separates conditions studied by health researchers from conditions actively litigated.
  • Connects you to our current PFAS lawsuit, AFFF, settlement amount and update pages.
  • Explains why a PFAS blood test can show what is in your body but cannot, on its own, reveal the source or prove causation.
What health agencies say: ATSDR reports evidence of an association between PFOA exposure and kidney and testicular cancer, and the EPA includes higher risk of some cancers, such as prostate, kidney and testicular, among possible effects of certain PFAS exposures. Those public health findings do not prove legal causation in any single lawsuit.

Federal Litigation Update

Where PFAS / AFFF MDL 2873 Stands in August 2026

In re: Aqueous Film-Forming Foams Products Liability Litigation, MDL No. 2873, is consolidated in the U.S. District Court for the District of South Carolina before Judge Richard M. Gergel. It covers personal injury, medical monitoring, property, public water system and other PFAS claims.

15,246 Pending Actions

The JPML's August 3, 2026 report shows 15,246 pending and 19,822 historical actions tied to MDL 2873.

Group B Deadline Extended

Entered July 30, CMO 26O pushed the deadline for Group B selection and expert-discovery proposals from July 20 to November 20, 2026. The order concerns thyroid disease and ulcerative colitis bellwether plaintiffs.

Rule 702 Briefing

Under CMO 33E, Rule 702 motions on general-causation experts for thyroid and/or liver cancer are due August 24, 2026, with responses due October 8 and replies November 2.

Bellwether trials do not create a payout chart. A condition named in a court order does not mean everyone with that diagnosis qualifies, proves causation or has a set value.
Screening Factors

Who Should Consider a PFAS or AFFF Claim Review?

Injury claims turn on individual facts. A good review examines how the exposure happened, which PFAS or products were involved, the diagnosis and latency period, medical evidence, who the defendants are, damages and the governing law.

Facts That May Warrant a Closer Look

  • Documented exposure through work, military service, an airport, firefighting, industry or contaminated water
  • Kidney or testicular cancer along with a plausible PFOA or PFAS exposure history
  • Another serious diagnosis under review in the litigation or backed by relevant research
  • Medical records showing diagnosis, treatment, outlook and a consistent timeline
  • AFFF, employer, base, water system, location or contamination records that support exposure
  • Medical bills, lost income, disability or other documented losses

Situations Needing More Individual Analysis

  • You suspect exposure but the source, product, place or dates are unclear
  • You have a PFAS blood test but no evidence of where or when exposure occurred
  • Evidence linking your diagnosis to the specific PFAS and exposure level is limited or contested
  • You were exposed but have no diagnosed injury or legally recognized damages
  • The statute of limitations, statute of repose or notice deadline is unclear
  • Several environmental or job-related exposures complicate causation

Illustrative PFAS Lawsuit Payout Bands

These bands are educational planning tools. They are not reported injury averages, court-approved tiers or guaranteed amounts, and they track Legal Lawsuit's current PFAS Settlement Amounts research.

Exposure Only

No Diagnosed, Compensable Injury

Cannot Be Reliably Estimated

Medical monitoring, property or other claims need their own legal analysis; exposure by itself does not produce a dependable injury value.

No standard injury value applies.
Illustrative Tier 1

Documented Claim, Lower Impact

$75K–$150K

Proven exposure plus a supported condition, treatment and measurable losses, but less severe impairment or smaller financial harm.

Editorial estimate by Legal Lawsuit only.
Illustrative Tier 2

Serious Illness Claim

$150K–$300K

A serious diagnosis, stronger exposure proof, significant treatment and real financial or quality-of-life effects.

Editorial estimate by Legal Lawsuit only.
Illustrative Tier 3

Severe Cancer or Lasting Harm

$300K–$500K+

Advanced or severe disease, permanent impairment, strong exposure evidence, extensive treatment or unusually large financial losses.

Catastrophic injury and wrongful death claims may need separate review and can fall outside this band.
There is no official injury payout grid. Published estimates should never be treated as guaranteed PFAS settlement amounts per person.
Water System Settlements Are Separate

3M and DuPont-Related Water Settlements Do Not Pay Individual Cancer Claims

Big settlements with public water systems are major milestones, but they resolve specific claims by drinking water providers and do not automatically compensate individuals with injury claims.

3M Water System Settlement

According to 3M's 2025 Form 10-K, the public water system settlement approved in 2024 provides for total payments of roughly $10.5 billion to $12.5 billion, paid out through 2036.

Chemours, DuPont and Corteva

The three companies announced a $1.185 billion fund resolving defined PFAS drinking water claims brought by a class of U.S. public water systems.

Why it matters: Dividing these water system totals by the number of injury plaintiffs would create a misleading “average,” because the classes, injuries, damages and allocation methods are entirely different.
Health Evidence

PFAS and Health: What Federal Agencies Actually Report

ATSDR says epidemiological research points to associations between greater exposure to particular PFAS and a range of health effects. For PFOA, it cites evidence of an association with kidney and testicular cancer, and its guidance for clinicians describes sufficient evidence for kidney cancer and limited or suggestive evidence for testicular cancer under the National Academies framework.

The EPA's PFAS health risk page includes higher risk of certain cancers, such as prostate, kidney and testicular cancer, among effects that may follow exposure to some PFAS at certain levels. Research continues, and evidence strength varies by chemical, disease and exposure history.

A scientific association does not prove causation in your case. A lawsuit still needs case-specific proof of exposure, diagnosis, timing, defendants, damages and the governing law.
Evidence Checklist

Records Attorneys May Review in a PFAS Claim

  • Work history in the military, at airports, in firefighting or in industry
  • Records of AFFF use, training, purchases or incidents
  • Water testing results and contamination notices
  • Where you lived and when, relative to possible PFAS sources
  • PFAS blood test results, if you have them
  • Pathology, imaging and specialist notes
  • Dates of diagnosis and treatment
  • Records of surgery, chemotherapy or other treatment
  • Medical bills and out-of-pocket costs
  • Lost pay and reduced earning ability
  • Disability and caregiving records
  • Evidence of the product, manufacturer or location
Blood tests have limits. ATSDR notes that PFAS blood tests measure certain PFAS present when the sample is taken, but they cannot predict current or future illness or reveal where or when exposure happened.
Claim Valuation

Six Factors That Shape a PFAS Lawsuit Payout

1. Exposure Pathway

Direct AFFF use, workplace contact, contaminated drinking water, location evidence and how long exposure lasted all affect proof.

2. Diagnosis

The type of cancer or disease, its stage and severity and any competing risk factors bear on causation and damages.

3. Treatment & Prognosis

Surgery, chemotherapy, hospital stays, recurrence, lasting impairment and future care influence damages.

4. Economic Loss

Medical costs, lost income, reduced earning capacity, travel, caregiving and loss of household services may count.

5. Proof of Product and Location

Documents identifying AFFF products, manufacturers, job sites, water systems and contamination sources can be decisive.

6. Law & Defenses

Jurisdiction, limitations and repose periods, defendant-specific defenses and MDL orders can significantly change viability and value.

Filing Considerations

PFAS Filing Deadlines Differ by Claim and State

No single national deadline covers every PFAS or AFFF injury claim. Timing can turn on state law, the diagnosis, discovery, exposure, the defendant, claim type, statutes of repose, government notice rules and MDL orders.

Do not rely on this tool to judge timeliness. Deadlines require legal analysis of your specific claim.

Common Questions

PFAS Settlement Calculator FAQs

Does the calculator predict my exact payout?

No. It produces an educational estimate from limited inputs and cannot reflect every medical record, expert opinion, defense, jurisdictional rule, deadline or future ruling.

What is the average PFAS injury settlement in 2026?

No official average or national injury payout schedule has been announced or approved by a court, and public water system settlements should not be read as individual cancer payouts.

How many cases are pending in the AFFF MDL?

According to the JPML's August 3, 2026 report, MDL 2873 has 15,246 pending and 19,822 historical actions.

What became of the July 20 Group B deadline?

Under CMO 26O, the selection and expert-discovery proposal deadline now falls on November 20, 2026.

Do I need a PFAS blood test?

It depends on the claim and strategy. ATSDR cautions that blood testing has real limits and, by itself, does not identify a disease or the source or date of exposure.

Must I ask to be contacted by an attorney to use the calculator?

No. You can get an educational estimate without requesting any contact; asking an attorney or expert to reach out is entirely optional.
