What Asbestos Is

Asbestos is a group of naturally occurring mineral fibers that was used for decades in insulation, roofing, flooring, brake parts, cement products and many industrial materials because it resists heat and fire. When asbestos-containing materials are disturbed, tiny fibers can be inhaled or swallowed and lodge in the lining of the lungs, abdomen or heart. Over many years, those fibers can cause inflammation and scarring and lead to diseases such as mesothelioma, lung cancer, asbestosis and pleural disease. Symptoms often appear 20 to 50 years after exposure, which is why many people are diagnosed long after they left the job where exposure happened.

Who Was Exposed

Exposure was common in shipyards, construction, power plants, refineries, steel mills, auto repair and the military, especially the Navy. Family members were sometimes exposed through fibers carried home on work clothes. Exposure can also come from older buildings and certain consumer products, including some talc products alleged to contain asbestos.

Diseases Linked to Asbestos

The diseases most often involved in asbestos claims are mesothelioma, an aggressive cancer of the lining of the lungs, abdomen or heart; lung cancer; asbestosis, a scarring of lung tissue; and other cancers such as laryngeal and ovarian cancer. Mesothelioma is so strongly associated with asbestos that a diagnosis usually leads directly to an investigation of past exposure.

Asbestos Lawsuit Requirements

To bring an asbestos claim, you generally need:

  • A qualifying diagnosis: Mesothelioma, asbestos-related lung cancer, asbestosis or another recognized asbestos disease, supported by medical records and pathology.
  • Proof of exposure: Work history, military records, product identification and witness accounts showing where and how you were exposed.
  • A responsible defendant or trust: A company that made, sold or used the asbestos products, or a bankruptcy trust set up to pay claims.
  • A timely filing: A claim filed within your state’s statute of limitations, which usually starts at diagnosis.

An attorney can help identify the products and companies involved even when the exposure happened decades ago.

Can You Sue Your Employer for Asbestos Exposure?

Usually, workers’ compensation is the main remedy against an employer, and direct lawsuits against employers are limited. Most asbestos lawsuits are instead brought against the manufacturers and suppliers of asbestos products, which is why identifying the specific products you worked with matters so much. Veterans generally cannot sue the military but may qualify for VA benefits and can still bring claims against product manufacturers.

Lawsuits and Asbestos Trust Funds

Many former asbestos manufacturers went bankrupt and created trusts to pay present and future claims. Victims can often file claims with several trusts and also bring a lawsuit against companies that are still in business. Common legal theories in asbestos cases include:

  • Failure to warn about known dangers
  • Negligence in manufacturing, selling or using asbestos products
  • Strict liability for defective products
  • Wrongful death claims by surviving family members

Evidence of what companies knew about asbestos hazards, sometimes going back decades, often plays a central role.

Can Family Members File an Asbestos Claim?

Yes, in many situations. Family members may bring:

  • Their own claims if they developed a disease from secondhand exposure, such as fibers on a worker’s clothing.
  • Wrongful death claims after a loved one died from an asbestos disease.

If this describes your family, a free, confidential review can help you understand your options and deadlines.

How Asbestos Cases Are Handled

Asbestos cases are typically filed individually in state or federal court, and some courts have dedicated asbestos dockets that move cases faster because of patients’ prognosis. Trust claims are filed separately through each trust’s procedures. An experienced attorney can pursue both paths at the same time.

What Asbestos Claims May Be Worth

Value depends heavily on the diagnosis, exposure history, the number of responsible companies and trusts, and the state where the case is filed. Mesothelioma claims tend to have the highest values, but no amount is guaranteed.

Factors that commonly affect value:

Factor Why It Matters
Diagnosis Mesothelioma usually carries the highest value
Exposure Proof Product and job evidence links defendants to the disease
Defendants and Trusts More solvent companies and trusts can mean more sources of payment
Personal Losses Age, earnings, medical costs and family impact

Value usually turns on the diagnosis, age, lost earnings, medical costs, the strength of exposure evidence and the defendants and trusts available.

How Long Does an Asbestos Case Take?

Many asbestos lawsuits resolve within one to two years, and courts often expedite cases for seriously ill plaintiffs. Trust claims can be paid on their own timelines, sometimes within months once approved.

What Is the Deadline to File?

Most states allow one to three years from the date of diagnosis, and wrongful death claims have separate deadlines that usually run from the date of death. Because asbestos diseases appear so long after exposure, the deadline is usually tied to diagnosis rather than exposure, but it can still pass quickly.
